COSHH - Use of hazardous chemicals in the workplace

Employers who use hazardous chemicals in the workplace are obliged by the COSHH regulations (SI 2002/2677) to ensure that their employees are not exposed to undue risk. A risk assessment is obligatory and this may lead to the need for monitoring of workplace atmosphere, health surveillance and improvement measures. COSHH was introduced in 1992, the 2002 regulations meet the requirements of the Chemical Agents Directive (CAD) and came into effect 21 November 2002. Dangerous Substances and Explosive Atmospheres Regulations (DSEAR) 2002

This new legislation which enacts part of the European Chemical Agents Directive was published in 2002 (SI 2002/2776) and came fully into effect 30 June 2003. DSEAR provides a physico-chemical equivalent of the COSHH regulations. COSHH covers health hazards whilst DSEAR covers fire, explosion and other such hazards. DSEAR implements the Explosives Atmosphere Directive (ATEX 137) 1999/92/EC and the safety aspects of the Chemicals Agents Directive (CAD). (note: CAD also deals with the health aspects which is being implemented by amendments to COSHH). DSEAR implements measures to reduce the risks from fires, explosions and other energy releasing events (eg. exothermic chemical reactions) arising from the use of dangerous substances.
